The School Board of the Parish of Lafayette, State of Louisiana, met in regular session at its meeting place, the Lafayette Parish School Board Administrative Building, Board Room, Lafayette, Louisiana, on Wednesday, August 12, 2015 at 5:30 P.M. pursuant to notice given in writing to everymember.

 

MEMBERS PRESENT: Tommy Angelle, President;Dawn Morris, Vice-President; Elroy Broussard, Justin Centanni,Tehmi Chassion, Jeremy Hidalgo,Erick Knezek, Britt Latiolais, and Mary Morrison Board Members; Donald W. Aguillard, Secretary- Treasurer/Superintendent

 

MEMBERS ABSENT:  None

 

I.          MEETING OPENINGS

 

The meeting was called to order by Angelle. Knezek led the group in the pledge, followed by a Moment of Silence.

 

APPEARANCES

 

The following candidates addressed the Board: Gerald Boudreaux, Candidate for Louisiana State Senate District 24; Mark Garber and Chad Leger, Candidates for Lafayette Parish Sheriff; Joel Robideaux,Candidate for City-Parish President;and Mike Kreamer, Candidate for District 7 BESE.

 

OPENING COMMENTS – SUPERINTENDENT

 

Superintendent Aguillard reported to the Board that of the 179 employees hired, 163 are classroom teachers, and that the school system would be about 13 teachers short when school opens. He said that the Human Resources Department had been working constantly to get teachers in place. Dr. Aguillard also reported that there had been several changes to bus routes and bus drivers, and parents could click on the Transportation link and see the most up-to-date information. He encouraged parents to be at bus stops at least 15 minutes early.

 

He also said that a request to change Truman Early Childhood Center bell times could not be made at this time because buses also service A. Boucher Elementary. In order to allow early dismissal at Truman, at least 13 new buses would be needed, but financially the Board could not incur the expense.

 

Superintendent Aguillard reminded citizens that it is illegal to pass a school bus, and asked that they be careful around buses so children can be transported safely. He said staff has been doing much preparation and planning for a smooth school opening. He ended by thanking parents for giving the school system an opportunity to teach their children, committed to raising student achievement, and protect and ensure children are given best effort possible.

 

ADDITIONS TO THE AGENDA

 

Motion (Morris, Morrison) That the Board pull the following Introduction Items from the agenda:  2. Recommendation for Changes to the Enhanced PPO Plan; 3. Recommendations for Changes to the Basic PPO Plan; 4. Recommendations for Changes to the High Deductible Health Plan; 5. Recommendations for Changes to the Prescription Drug Program; 6. Recommendations to Adjust Premiums for Medicare-Eligible Retirees; and 7. Recommendation to Offer Medicare Advantage HMO. Motion carried.

 

APPROVAL OF AGENDA

 

Motion (Broussard, Morris) That the Board approve the agenda as amended. Motion carried.

 

II.         RECOGNITIONS AND PRESENTATIONS

 

The Board congratulated Lafayette Parish School System for being recognized by two national organizations, the Association of School Business Officials International (ASBO) and the Government Finance Officers Association (GFOA). Both organizations recently bestowed "Excellence in Financial Reporting" awards to LPSS for the 2013- 2014 Comprehensive Annual Financial Report (CAFR). The school system is the only governmental entity in the Acadiana region to receive such recognition, which represents a significant achievement and reflects a commitment to the highest standards of school system financial reporting. Billy Guidry, Chief Financial Officer and Matt Dugas, Director of Finance received the award on behalf of the school system.

 

III.        CORRECTIONS AND/OR APPROVAL OF BOARD MEETING AND COMMITTEE MEETING MINUTES

 

Motion (Morris,Knezek) That the following minutes be approved In Globo: 1. Regular Board Meeting of 7/1/15 and 7/8/15; 2. Employee Insurance Committee Meeting of 7/14/15,7/29/15/ and 8/3/15; 3. Special Board Meeting and Finance Committee Meeting of 7/29/15; and 4. Board Workshop and Regular Board Meeting of 8/5/15. Motion carried.

 

IV.        FINANCIAL INFORMATION AND REPORTS

 

Motion (Morris, Centanni) That the Board receive the Sales Tax Collection Report for the month of June 2015; and 2. Ratification of Bills for June 2015; 3. Budget-to-Actual Status Report; 4. Summary of Grant Funding and Activity; and 5. Ratification of Purchases July, 2015. Motion carried.

2.         Career Exploration "I CAN DO THAT!" Video Series

 

Robin Olivier, Director of Career and Technical Education/Schools of Choice, informed the Board that the school system had contracted with Creative Video Productions to produce an inspiring Career Video series entitled “I Can Do That!” to aid in student exploration of career opportunities with a focus on south Louisiana jobs. She said the school system had collaborated with the Workforce Investment Board to formulate which jobs would be targeted.  The three to six minute videos on Automotive, CNA, Culinary, Computer Programmer, Drafting, Electrical, etc. could be found at: http://www.lpssonline.com/site6125.php.

 

3.         Creation of a School Board Insurance Committee

 

Board President Angelle created a School Board Insurance Committee to receive and consider insurance matters. The following Board members will serve on the committee: Tommy Angelle, Justin Centanni, and Jeremy Hidalgo.

Motion (Latiolais, Centanni) That the Board move 2015-2016 Pupil Progression Plan to the Action Agenda. Voting for were Angelle, Broussard, Centanni, Hidalgo, Knezek, Latiolais, Morris and Morrison.  Voting against was Chassion.  Motion carried.

 

VI.        TIME SENSITIVE ACTION ITEMS

 

1.         Approval of Resolution 08-15-1865 Employ Special Counsel to employ the firm of Roy Kiesel Ford Doody and Thurmon, APLC.

 

RESOLUTION 08-15-1865 EMPLOY SPECIAL COUNSEL

 

WHEREAS, Louisiana Revised Statutes42:263 authorizes the retention of special counsel by any School Board upon a statement of reasons why such counsel is necessary and upon approval by the Louisiana Attorney General; and,

 

WHEREAS, Lafayette Parish School Board and its staff are in need of special counsel experienced in trademark law and litigation in representing the School before the Trademark Trial and Appeal Board; and

 

WHEREAS, Stephen R. Doody and his law firm, Roy Kiesel Ford Doody & Thurmon, APLC of Baton Rouge, Louisiana, in his individual capacity and as an attorney has such experience, training and expertise in trademark and intellectual property law to represent the Lafayette Parish School Board; and,

 

THEREFORE, BE IT DULY RESOLVED, by the Lafayette Parish School Board in regular session duly commenced:

 

Section 1 – The School Board does employ Stephen R. Doody and his law firm, Roy Kiesel Ford Doody & Thurmon, APLC of Baton Rouge, Louisiana, in his individual capacity, as special counsel with respect to handling matters involving trademarks and any other intellectual property legal matters that are deemed by the Board and/or Superintendent as necessary.

 

Section 2 - Said Stephen R. Doody and his law firm, Roy Kiesel Ford Doody  & Thurmon, APLC of Baton Rouge, Louisiana shall be paid for his services at the maximum hourly rates set by the Attorney General of the State of Louisiana for Special Counsel with like years of experience, as those rates exist or maybe amended in the future; and to be reimbursed for reasonable and necessary out-of-pocket expenses for long distance telephone calls, document duplication, expert witness fees, court reporter fees, printing costs,travel expenses, and other expenses incurred as a result of the legal services to and for the Board; and,

 

Section 3 - Said Stephen R. Doody and his law firm, Roy Kiesel Ford Doody & Thurmon, APLC of Baton Rouge, Louisiana shall keep itemized records for presentation to the Superintendent, the Lafayette Parish School Board with respect to the services rendered at said hourly rates with the fees and charges and the Superintendent is hereby authorized and directed to pay the same upon submission and receipt thereof.

 

Section 4 – This employment is effective as of July 10, 2015.

 

Section 5 - Subject to the approval of this resolution by the Attorney General, the employment of Stephen R. Doody and his law firm, Roy Kiesel Ford Doody & Thurmon, APLC of Baton Rouge, Louisiana is confirmed regarding expertise in trademark and intellectual property matters handling for the School Board.

2.         Updating of Lafayette Parish School System Master Facilities Plan

 

Motion (Centanni, Latiolais) That the Board accept the recommendation of the Finance Committee with regards to the proposal submitted by CSRS for the services to be provided in updating the Facilities Master Plan. Motion carried.

 

3.         Approval of Sealed Quotes for Milton Elementary Portable Building Classroom Refurbishing

 

Motion (Hidalgo, Latiolais) That the Board authorize staff to award the low quote to L. Michaud Construction for $34,960 for the Milton Elementary Portable Building Refurbishing in accordance with Lafayette Parish School System Purchasing Department regulations.

 

A substitute motion was made by Broussard and seconded by Centanni that the Board look at other alternatives to refurbish portable building, either by purchasing a new building, or purchasing a building less than five years old.

 

After some discussion, the makers of the substitute motion and the original motion rescinded their motions.

 

Motion (Centanni, Latiolais) that the Board lease a double classroom portable building for Milton Elementary/Middle School.

 

A substitute motion was made by Knezek and seconded by Hidalgo that the Board purchase a double portable classroom for Milton Elementary/Middle School not to exceed $100,000.00.

 

The Chair called for the vote on the substitute motion.

 

Voting for were Broussard, Chassion, Hidalgo, Knezek and Morrison. Voting against were Angelle, Centanni, Latiolais and Morris. Motion carried.

 

Board member Chassion informed the Chair that his vote under Move Items to Action: Pupil Progression Plan should have been a YES.

 

The Chair asked that the Board members revote on moving the 2015-2016 Pupil Progression Plan to the Action Agenda.

 

A motion was made by Chassion and seconded by Morrison that the Board move the 2015-2016 Pupil Progression Plan to the Action Agenda.

 

Voting for were Angelle, Broussard, Centanni, Chassion, Hidalgo, Knezek, Latiolais, Morris and Morrison.  Voting against was none. Motion carried.

 

4.         2015-2016 Pupil Progression Plan

 

Motion (Centanni, Morrison) That the Board approve the 2015-2016 Pupil Progression Plan for Lafayette Parish.

 

A substitute motion was made by Knezek and seconded by Morris that the Board approve the 2015-2016 Pupil Progression Plan, and that the 60% summative assessments and 40% formative assessments be a recommendation and not a mandate.

 

Voting for were Angelle, Broussard, Centanni, Chassion, Hidalgo, Knezek, Latiolais, Morris and Morrison.  Motion carried.
